EVENT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND DAMAGE RESPONSIBILITY AGREEMENT
This Event Waiver, Release of Liability, Assumption of Risk, and Damage Responsibility Agreement ("Agreement") is entered into by and between Royal Ayers Mobile Cigar Lounge ("Royal Ayers," "Company," "we," "us," or "our") and the undersigned client, booking party, responsible host, or participant ("Client," "Responsible Party," "I," "me," or "my").
This Agreement applies to the booking, use, attendance, access to, participation in, and presence at any Royal Ayers mobile cigar lounge event, service, experience, vehicle, trailer, truck, setup, or event-related environment.
By signing this Agreement, booking services, making payment, or entering or allowing others to enter the Royal Ayers lounge environment, I acknowledge that I have read, understood, and voluntarily agree to all terms below.
1. Purpose of This Agreement
Royal Ayers provides a mobile luxury cigar lounge experience for adult events, including but not limited to weddings, corporate events, networking functions, private celebrations, parties, and similar gatherings.
Because this experience involves a mobile unit, adult-use products, cigar smoke, social event conditions, furnishings, equipment, guest activity, and potential health and property risks, this Agreement is intended to:
- confirm age restrictions;
- establish guest rules and conduct standards;
- allocate responsibility for damage, cleanup, and misuse;
- confirm assumption of risk;
- limit Royal Ayers' liability to the fullest extent permitted by law;
- protect Royal Ayers, its owners, staff, contractors, and property; and
- provide a clear basis for removal, event termination, and reimbursement where needed.
2. Adult-Only Event and 21+ Entry Requirement
I understand and agree that Royal Ayers Mobile Cigar Lounge is strictly for adults age 21 and over.
No person under the age of 21 may enter, occupy, access, or participate in the Royal Ayers lounge environment under any circumstance, even if:
- the broader event includes family members or minors;
- the event is a wedding or mixed-age celebration;
- the underage person is supervised by a parent or guardian; or
- the client, host, or guest requests an exception.
Royal Ayers reserves the absolute right to:
- request valid government-issued identification;
- verify age before entry;
- deny entry to any person whose age cannot be confirmed;
- remove any underage individual;
- suspend service if underage access is attempted or permitted; and
- terminate participation or event access without refund where age restrictions are violated.
I understand that it is my responsibility, as the booking client or responsible host, to inform all guests in advance that the Royal Ayers lounge is strictly 21+ only.
3. Assumption of Risk
I understand that attendance at or participation in a mobile cigar lounge event involves inherent and unavoidable risks, including but not limited to:
- exposure to cigar smoke, tobacco odor, and smoke residue;
- irritation related to smoke, scent, or air quality;
- slips, trips, and falls in or around the mobile unit;
- injury caused by guest movement or crowding;
- accidental contact with cigars, ash, heat, or related items;
- risks associated with alcohol consumption or intoxicated behavior by guests;
- risks related to a mobile event environment, vehicle access, steps, entry points, flooring, furniture, and limited movement space;
- damage to personal property;
- discomfort arising from weather, venue conditions, or the conduct of others; and
- the possibility of injury, illness, property loss, or other harm.
I knowingly and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, associated with my participation in or attendance at the Royal Ayers experience, except to the extent caused by conduct that cannot lawfully be waived under applicable law.
4. Health Acknowledgment
I understand and acknowledge that cigar smoke and related environmental conditions may aggravate certain health conditions. I further understand that the lounge may not be suitable for persons with:
- asthma;
- respiratory issues;
- smoke sensitivity;
- allergies;
- pregnancy-related sensitivities;
- cardiovascular concerns;
- immune sensitivities; or
- other medical conditions affected by smoke, scent, or enclosed social environments.
I acknowledge that it is my sole responsibility, and the responsibility of each guest, to determine whether participation is appropriate based on personal health, medical condition, comfort, and tolerance.
Royal Ayers does not provide medical advice and is not responsible for any discomfort, reaction, aggravation, illness, or condition arising from voluntary participation, except where liability cannot legally be disclaimed.
5. Client Responsibility for Guests
If I am the booking client, host, or responsible party, I understand and agree that I am fully responsible for the conduct of my guests, invitees, attendees, vendors, representatives, and any person allowed by me or my event to access or attempt to access the Royal Ayers lounge.
This responsibility includes, without limitation:
- informing guests of all age restrictions;
- informing guests of conduct expectations;
- helping prevent misuse, damage, overcrowding, or unsafe conduct;
- ensuring guests do not bring prohibited items into the lounge;
- ensuring guests behave lawfully and respectfully;
- and accepting financial responsibility for damage, excessive mess, cleanup, or loss caused by my guests.
I understand that Royal Ayers may hold me financially responsible for acts committed by my guests or by persons connected to my event.
6. Guest Conduct Rules
I agree, and will ensure that all guests agree, that the following conduct is prohibited in or around the Royal Ayers lounge environment:
- entry or attempted entry by any person under 21;
- disorderly, aggressive, threatening, abusive, or harassing conduct;
- fighting or physical altercations;
- reckless horseplay;
- intentional damage or tampering with the mobile unit, furnishings, decor, ventilation, windows, lighting, doors, fixtures, electronics, or equipment;
- theft or attempted theft;
- use or possession of illegal drugs or illegal substances;
- possession of weapons or dangerous items prohibited by law or event policy;
- unsafe cigar handling;
- throwing or dropping ash, cigars, glass, or debris in an unsafe manner;
- standing, climbing, hanging, or sitting on areas not intended for such use;
- vandalism;
- smoking, drinking, or conduct in violation of any specific instructions issued by Royal Ayers staff;
- any unsanitary or biohazard-causing behavior; and
- any conduct that interferes with safe, professional, or lawful operation.
I understand that Royal Ayers has sole discretion to determine whether conduct is unsafe, inappropriate, destructive, unlawful, or disruptive.
7. Right to Refuse Entry, Remove Guests, or Terminate Access
I understand and agree that Royal Ayers reserves the absolute right, in its sole discretion, to: deny entry to any person; require age verification before entry; remove any guest from the lounge area; suspend service temporarily; close access to the lounge; terminate lounge operations during the event; or end the event experience without refund
if Royal Ayers determines that any person is:
- underage or unable to verify age;
- intoxicated or impaired to an unsafe degree;
- disorderly or disruptive;
- destructive or reckless;
- threatening, abusive, or noncompliant;
- attempting prohibited conduct; or
- creating a safety, health, legal, reputational, or operational risk.
I further agree that Royal Ayers shall not be liable to me for any disappointment, disruption, guest dissatisfaction, reduced event enjoyment, or financial loss resulting from enforcement of these rules.
8. Damage Responsibility
I agree to be fully financially responsible for any damage, destruction, alteration, loss, or extraordinary wear caused by me or any guest, invitee, attendee, or person associated with my event.
This includes damage to, or involving:
- the vehicle, truck, trailer, or mobile unit itself;
- entry steps, doors, handles, locks, and access points;
- seating, tables, bars, counters, cabinetry, shelves, and furniture;
- interior walls, ceilings, flooring, trim, and fixtures;
- windows, glass, mirrors, lighting, and decor;
- cigar accessories, tools, displays, humidors, cutters, ashtrays, and related items;
- electronics, speakers, screens, power systems, or equipment;
- upholstery, finishes, fabrics, and decorative materials; and
- exterior surfaces or components affected during the event.
I agree that Royal Ayers may assess the cost of repair, replacement, restoration, loss of use, labor, administrative handling, transport, vendor coordination, and downtime associated with any such damage, and I agree to pay all such amounts upon demand or invoice.
9. Excessive Cleaning, Vomit, Bodily Fluids, and Biohazard Charges
I understand and agree that I am financially responsible for excessive cleaning, sanitation, remediation, and restoration costs resulting from unsanitary or abnormal conditions caused by me or my guests.
This includes, but is not limited to:
- vomit;
- urine;
- blood;
- feces;
- bodily fluids of any kind;
- broken glass requiring specialty cleanup;
- severe spills;
- smoke misuse causing damage;
- burns;
- food or beverage saturation;
- strong odors requiring treatment;
- trash overload;
- sticky residues; or
- any condition requiring abnormal cleaning or temporary removal from service.
If professional cleaning, specialty sanitation, biohazard treatment, deodorization, replacement, remediation, or out-of-service restoration is required, I agree to pay the full amount incurred by Royal Ayers, including labor, contractor charges, materials, administrative handling, and lost-use damages.
10. Lost Revenue / Out-of-Service Damages
I understand that damage or contamination to the Royal Ayers lounge may cause the unit to be unavailable for future bookings. If damage, excessive mess, biohazard conditions, or misconduct caused by me or my guests results in downtime, canceled bookings, repair delays, or temporary unavailability, I agree that Royal Ayers may seek reimbursement not only for direct repair and cleaning costs, but also for reasonable loss-of-use or lost-revenue damages resulting from the unit being out of service.
11. No Responsibility for Personal Property
I understand that Royal Ayers is not responsible for personal belongings brought into or near the lounge environment. I voluntarily assume all risk of loss, theft, or damage to personal property, including but not limited to:
- phones;
- wallets;
- purses;
- jewelry;
- clothing;
- gifts;
- business materials;
- accessories; and
- other personal items.
Royal Ayers has no duty to secure, monitor, insure, or recover personal property for any guest or attendee.
12. Release of Liability
To the fullest extent permitted by law, I, on behalf of myself and, where applicable, my heirs, assigns, estate, personal representatives, agents, guests, and any party claiming through me, hereby release, waive, discharge, and hold harmless Royal Ayers and its owners, officers, employees, contractors, affiliates, representatives, successors, and assigns from and against any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses of any kind, whether known or unknown, arising out of or related to:
- attendance at or participation in the Royal Ayers event experience;
- entry into or use of the mobile lounge;
- smoke exposure;
- ordinary event-related accidents;
- guest conduct;
- alcohol-related guest behavior not directly caused by Royal Ayers;
- enforcement of age restrictions;
- refusal of entry or guest removal;
- interruption or termination of service for policy enforcement;
- loss or damage to personal property; or
- any other incident related to the use of the lounge, except to the extent caused by conduct that cannot lawfully be released under applicable law.
13. Indemnification
I agree to defend, indemnify, and hold harmless Royal Ayers and its owners, officers, employees, contractors, agents, affiliates, and representatives from and against any and all claims, suits, demands, liabilities, judgments, damages, losses, fines, penalties, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- my breach of this Agreement;
- the acts or omissions of my guests or event attendees;
- underage access attempts or violations;
- property damage;
- bodily fluid or cleanup incidents;
- misconduct, unlawful conduct, or negligence by me or my guests;
- disputes caused by guest removal or event shutdown due to policy enforcement; or
- my failure to disclose relevant event conditions or obtain necessary event permissions.
14. Event Safety and Compliance Authority
I acknowledge that Royal Ayers has sole discretion to establish and enforce operational, safety, sanitation, crowd control, age-verification, and conduct-related rules as needed to protect the business, its property, staff, and guests.
I agree to comply immediately with all instructions given by Royal Ayers staff, and I agree that Royal Ayers' decisions regarding safety, access, operations, and enforcement shall be final during the event.
15. No Refund for Policy Violations
I understand and agree that if Royal Ayers denies entry, removes guests, suspends service, limits access, or terminates operations due to:
- underage access attempts,
- guest misconduct,
- damage,
- intoxication,
- unsanitary behavior,
- threats to safety,
- prohibited conduct, or
- other violations of this Agreement,
I shall not be entitled to any refund, credit, reduction, or offset unless Royal Ayers expressly agrees otherwise in writing.
16. Permission to Charge for Damages or Additional Costs
If I have provided a payment method, card authorization, invoice agreement, or other payment arrangement in connection with my booking, I authorize Royal Ayers, to the extent permitted by law and by the applicable service agreement, to charge or invoice me for:
- damage-related costs;
- excessive cleaning charges;
- biohazard remediation;
- overtime;
- unpaid balances;
- lost or missing items;
- repair coordination costs;
- restoration expenses; and
- other charges I am responsible for under this Agreement.
If direct charging is not authorized under the payment arrangement, I agree to pay any invoice issued for such amounts within the time stated by Royal Ayers.
17. Photography and Video Acknowledgment
I understand that Royal Ayers may photograph or record portions of the event or lounge setup for business, promotional, portfolio, branding, advertising, or social media purposes, subject to any separate consent process or written agreement.
By signing this Agreement, I acknowledge that:
- event photography or video may occur;
- Royal Ayers may request or document separate consent preferences where applicable;
- it is my responsibility to communicate any known restrictions in writing before the event; and
- Royal Ayers is not responsible for independent photography or videography conducted by guests, hosts, venues, photographers, or third parties outside of Royal Ayers' control.
18. No Representation of Security or Guest Control
I understand that Royal Ayers is not a security company, insurer, or guarantor of guest behavior. Although Royal Ayers may enforce rules and remove disruptive individuals, Royal Ayers does not guarantee that all risks, misconduct, or disruptive acts can be prevented.
19. Force Majeure and Operational Interruptions
I understand that Royal Ayers may suspend, delay, shorten, reschedule, or cancel participation where necessary due to safety issues, severe weather, road conditions, mechanical issues, emergency events, venue restrictions, legal compliance concerns, or other circumstances beyond Royal Ayers' reasonable control.
I agree that Royal Ayers shall not be liable for resulting inconvenience, delay, disappointment, or loss except as may be expressly stated in a separate written booking agreement.
20. Florida Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles, except where superseded by applicable federal law.
21. Severability
If any part of this Agreement is found invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
22. Entire Agreement as to Waiver Topics
This Agreement supplements, and does not replace, any applicable service agreement, terms of service, disclaimer, invoice terms, payment authorization, or event contract used by Royal Ayers. In the event of a conflict, Royal Ayers may rely on whichever provision provides the broader protection to the extent permitted by law and the parties' written agreements.
23. Voluntary Execution
I acknowledge that:
- I have read this Agreement carefully;
- I understand its contents;
- I understand that I am giving up certain legal rights;
- I understand that I may be held financially responsible for damage, cleanup, and misconduct;
- I have had the opportunity to ask questions before signing; and
- I sign or accept this Agreement voluntarily and without coercion.
